PRICE AND PAYMENT METHOD

As a general rule, the prices of the products or services displayed on the website include the applicable taxes. Shipping costs, if any, are not included and can be viewed during the purchase process.

The price that THE CUSTOMER must pay for the product or service and the payment method will be those indicated both in the SHUU BAREFOOT 2014 S.L store, as well as in the order.

The accepted payment methods are as follows:

● Bank card / Payment gateway

● Paypal

The establishment of a discount, offer, or benefit graciously granted by SHUU BAREFOOT 2014 S.L to THE CUSTOMER, even if it is recurring over time, will not imply its consolidation nor the indefinite right of the customer to enjoy it, nor will it mean a tacit or express waiver by SHUU BAREFOOT 2014 S.L to charge the full price on successive occasions.

Product or service prices may change at any time. In this case, the price to be applied will be the one in effect on the date the order is placed. In any case, the final cost will be communicated to the CUSTOMER during the electronic purchase process before they confirm their acceptance.

In the case of contracting special or customized products or services, whose price is not listed on the website, a specific quote will be prepared, which must be approved by THE CUSTOMER prior to contracting. Acceptance of this quote may imply acceptance of particular conditions, warnings, or instructions of a specific nature, substitutive or complementary to these general conditions.

TERMS

SHUU BAREFOOT 2014 S.L will send your order to the CUSTOMER, to their home or another address they choose, using the specialized and reliable providers it determines.

The delivery date to the CUSTOMER's address will depend on the shipping area and the availability of the chosen product in stock.

However, in any case, it is the CUSTOMER'S obligation to check the order details, especially the shipping address, costs, and delivery times, before placing the order. SHUU BAREFOOT 2014 S.L is not responsible for delays, holdups, or inability to deliver due to errors in the CUSTOMER'S data. Likewise, when errors in the CUSTOMER'S data generate shipping costs, these will be borne by the CUSTOMER. Errors not attributable to the CUSTOMER will not incur any cost.

WARRANTIES

Warranty periods for products purchased by consumers and users.

The following warranty periods are informed:

●  For new products purchased, the warranty period is three years from the moment of delivery of the purchased item..

●  For second-hand products purchased, the warranty period will be one year from delivery.

During the indicated periods, all defects covered by the warranty will be repaired free of charge. The warranty is void for any damage due to mishandling and improper use of the purchased item.

Non-compliant products purchased by consumers and users.

If defects or any other lack of conformity with the purchase appear during the first 2 years from the delivery of the product, the defect is presumed to be inherent. For second-hand products, the defect is presumed inherent if it appears during the first year from delivery. These presumptions will not apply in cases where they are incompatible with the nature of the product, for example, in the case of perishable products that do not have a long useful life.

In these cases, THE CUSTOMER may, by a simple declaration, demand the remedy of such lack of conformity (through repair or replacement), a price reduction, or contract termination.

Repair or replacement.

THE CUSTOMER may choose between demanding the repair or replacement of the product, unless one of these two options is impossible or, compared to the other corrective measure, entails disproportionate costs for the business.

The corrective measures of repair or replacement will comply with the following rules:

a) They will be free of charge for THE CUSTOMER. This free service will include the necessary expenses incurred to bring the goods into conformity, especially shipping, transport, labor, or materials costs.

b) They must be carried out within a reasonable time from the moment SHUU BAREFOOT 2014 S.L has been informed of the lack of conformity.

c) They must be performed without major inconvenience to THE CUSTOMER.

In accordance with the above rules, when repair or replacement of the good is appropriate, THE CUSTOMER will make it available to SHUU BAREFOOT 2014 S.L, which, if applicable, will recover the replaced good at its own expense in the way that causes the least inconvenience to THE CUSTOMER. Likewise, when a repair requires the removal of goods that have been installed, or when such goods are replaced, the obligation to repair or replace them will include the removal of the non-conforming goods and the installation of the replaced or repaired goods, or the assumption of the costs of such removal and installation by SHUU BAREFOOT 2014 S.L.

Finally, it is expressly informed that, in the case of opting for replacement, THE CUSTOMER will not be responsible for any payment for the normal use of the replaced goods during the period prior to their replacement.

Price reduction or termination.

The consumer or user may demand a proportional price reduction or contract termination, in any of the following cases:

a) CWhen the repair or replacement is impossible or disproportionate.

b) When SHUU BAREFOOT 2014 S.L has not carried out the repair or replacement of the goods, or when it has not done so within a reasonable time, provided that THE CUSTOMER had requested a price reduction or contract termination. It will also apply when it has not removed the replaced item at its own expense or has not taken charge of the removal and installation or their costs in the cases indicated in the previous section, again, provided that THE CUSTOMER had requested a price reduction or contract termination.

c) When SHUU BAREFOOT 2014 S.L has not carried out the repair or replacement complying with the rules indicated in the previous section.

d) When any non-conformity appears after SHUU BAREFOOT 2014 S.L's attempt to bring the goods or digital content or services into conformity.

e) When the non-conformity is so serious that immediate price reduction or contract termination is justified.

f) When SHUU BAREFOOT 2014 S.L has declared, or it clearly emerges from the circumstances, that it will not bring the goods or digital content or services into conformity within a reasonable time or without major inconvenience to the consumer or user.

If opting for a price reduction, it will be proportional to the difference between the value the good would have had at the time of delivery or supply if it had conformed to the contract and the value the good actually delivered or supplied has at that time.

The termination will not proceed when the non-conformity is of minor importance, except in cases where the consumer or user has provided personal data as consideration, with the burden of proof resting on the business.

When the non-conformity refers only to some of the delivered goods, THE CUSTOMER may terminate the contract only with respect to those goods and, regarding any of the other goods, may also terminate it if it cannot reasonably be expected that THE CUSTOMER accepts to keep only the conforming goods.

Upon termination of the contract, SHUU BAREFOOT 2014 S.L will refund THE CUSTOMER the price paid for the goods after their receipt or after receiving proof that THE CUSTOMER has returned them. In turn, THE CUSTOMER will return the goods to SHUU BAREFOOT 2014 S.L at the latter's expense.

CLAIMS HANDLING.

To report a non-conformity or file any other type of claim, THE CUSTOMER can writeto the postal address CL. SAN VICENTE MARTIR, 159 Pta. 4 46007, VALENCIA, or to the email hola@shuubarefoot.com .

WITHDRAWAL OF CONSUMERS AND USERS

THE CUSTOMER considered a consumer and user has the right to rescind the contract within fourteen calendar days, without indicating the reason for such rescission. This period is counted from its delivery to THE CUSTOMER, or to their authorized representative, other than the carrier.

To exercise their right of withdrawal, THE CUSTOMER must contact SHUU BAREFOOT 2014 S.L, with C.I.F. / N.I.F. B93990174, by postal mail to the address CL. SAN VICENTE MARTIR, 159 Pta. 4 46007, VALENCIA, or by sending an email to hola@shuubarefoot.com . In both cases, you must make a clear statement of your decision to exercise the right of withdrawal. You can also use the following Form (link to the form), although it is not mandatory.

 Effects of withdrawal

Once the right of withdrawal has been exercised, SHUU BAREFOOT 2014 S.L will refund THE CUSTOMER all amounts received, within a maximum period of fourteen calendar days from the date the notification is received. THE CUSTOMER must return the products to SHUU BAREFOOT 2014 S.L, within the same fourteen calendar days from the communication of withdrawal, and it must be accompanied by the documentation proving the contract: the delivery note, the issued invoice, etc.

For the refund of the amounts received by SHUU BAREFOOT 2014 S.L, the same payment method that THE CUSTOMER used in the original transaction will be employed.

The return includes delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive ordinary delivery method we offer). If the CUSTOMER has paid shipping costs, they will be refunded via bank transfer if all items in the order are returned.

SHUU BAREFOOT 2014 S.L we may withhold the refund until we have received the returned items back, or until it has been proven that THE CUSTOMER has returned the items, whichever happens first.

THE CUSTOMER must return the item without delay and, in any case, at the latest within fourteen calendar days from the moment you notify us of the withdrawal from this contract. The deadline is met if you send the item before the fourteen-day period.

THE CUSTOMER will only bear the direct costs of returning the goods, unless the entrepreneur has agreed to bear them or has not informed them that they are responsible for these costs.

In the case of contracts concluded outside the establishment where the goods have already been delivered to the CUSTOMER's home at the time the contract is concluded, SHUU BAREFOOT 2014 S.L will collect the goods at its own expense only when, due to their nature, they cannot be returned by mail.

If at the time of the return, SHUU BAREFOOT 2014 S.L has a physical store open to the public, THE CUSTOMER has the option to return it, within the indicated period, at one of the physical stores of SHUU BAREFOOT 2014 S.L. In this case, THE CUSTOMER must present the supporting documentation of the contract: the delivery note, the issued invoice, etc.

THE CUSTOMER will not have to refund any amount for the decrease in value of the good, which results from its use as a mere examination or test. Any use or handling that goes beyond merely testing the good (considering the need to verify its nature, characteristics, and functioning) and causes a decrease in its value will entail the obligation to reimburse that decrease in value by the buyer. Therefore, to avoid future compensation claims, it is recommended THAT THE CUSTOMER carefully examine the items and do not damage them.
